Section 1 - Definitions

In these Terms of Service, the following definitions apply:

1. Business: canadianfollowers.ca, operated by HeyTech Digital B.V., a company registered in the Netherlands.
2. Consumer: any natural person who enters into a legal transaction for purposes which are not in connection with their trade, business or profession (as defined under applicable consumer protection law).
3. Customer: the consumer or legal entity who enters into a contract with the Business.
4. Service: the social media marketing services offered by the Business, including but not limited to the provision of followers, likes, views and engagement on various social media platforms.
5. Distance Contract: a contract concluded between the Business and the Customer within a distance sales system, where remote means of communication are used exclusively up to and including the moment the contract is concluded.
6. Day: calendar day.
7. Digital Content: data produced and supplied in digital form.

Section 2 - Identity of the Business

Section 3 - Scope

1. These Terms of Service apply to all offers made by the Business and to every distance sales contract concluded between the Business and the Customer.
2. Before a distance sales contract is concluded, the Customer will be provided with the text of these Terms of Service. If this is not reasonably possible, the Business will indicate how these Terms of Service can be viewed.
3. By placing an order, the customer accepts these Terms of Service.
4. Should any provision of these Terms of Service be wholly or partly invalid, the remaining provisions shall remain unaffected.

Section 4 - The Offer

1. The offer contains a complete and accurate description of the services offered. The description is sufficiently detailed to enable the Customer to make an informed assessment.
2. All prices on the website are listed in Canadian Dollars ($) and represent the final amount payable. No VAT is charged.
3. Obvious errors or mistakes in the offer are not binding on the Business.
4. The Business does not guarantee that the services provided will lead to specific results on social media platforms. The effectiveness of the services may depend on factors outside the Business's control, including changes to platform algorithms and the quality of the Customer's content.
5. The Business is a marketplace provider of social media marketing services and is not affiliated with or endorsed by the relevant social media platforms.

Section 5 - Contract Conclusion

1. The contract is formed when the Customer accepts the offer and fulfils the associated conditions.
2. If the Customer has accepted the offer by electronic means, the Business will promptly confirm receipt of the acceptance by electronic means.
3. The Business may, within legal limits, check whether the Customer can meet its payment obligations. If there are reasonable grounds for concern, the Business is entitled to refuse an order or impose special conditions.

Section 6 - Right of Withdrawal

1. Under applicable consumer protection law, the right to cancel is excluded for service contracts where the service has been fully performed at the Consumer's request before the cancellation period expires, and the Consumer has been informed before the contract is concluded that they will lose their right to cancel.
2. By placing an order, the Customer expressly consents to immediate performance of the service and waives their right to cancel.
3. As performance of our services begins immediately upon payment and is often completed within minutes to hours, refunds are not possible after performance has begun.

Section 7 - Prices

1. All prices stated on the website are final prices in Canadian Dollars ($). No VAT is charged.
2. The Business reserves the right to change prices. Orders that have already been placed will be executed at the price that applied at the time of ordering.
3. Promotions and discounts apply for the specified period and cannot be combined with other offers unless otherwise stated.

Section 8 - Payment

1. The Customer must make payment before the service is performed.
2. Payment is made through the payment methods offered on the website, including credit card, PayPal, SEPA direct debit, Klarna and other available options.
3. The Customer is required to notify the Business immediately of any inaccuracies in payment data that has been transmitted or provided.

Section 9 - Delivery and Execution

1. The Business will exercise the utmost care in executing service orders.
2. Performance of the service begins immediately upon receipt of payment.
3. The estimated delivery time is typically 10–30 minutes, but may vary depending on the service chosen and external factors.
4. The Business endeavours to deliver the ordered quantity. Due to the nature of social media platforms, the actual quantity delivered may vary slightly from the order. The Business aims to minimise any such variance.
5. The Business is not responsible for delays caused by third parties, technical failures on social media platforms or other circumstances beyond its control.

Section 10 - Customer Obligations

1. The Customer warrants that the information provided (including username) is correct and complete.
2. The Customer warrants that they are authorised to order the services for the specified social media account.
3. The Customer must have a public account on the relevant social media platform in order to receive the service.
4. The Customer is responsible for complying with the terms of use of the relevant social media platform.
5. The Customer will not use the services for illegal, fraudulent or unethical purposes.
6. The Business does not request passwords or login credentials. The Customer must never share their passwords.

Section 11 - Liability

1. The Business is not liable for damage arising from the Customer's use of the services, including but not limited to:
   • Suspension or closure of the Customer's social media account by the relevant platform;
   • Decline in engagement or followers after service performance;
   • Algorithm changes by social media platforms;
   • Indirect loss, consequential damage or lost profits.
2. The Business's liability is in all cases limited to the amount the Customer paid for the relevant service.
3. The Business is not liable for damage caused by incorrect or incomplete information provided by the Customer.

Section 12 - Complaints

1. Complaints about contract performance must be submitted to the Business within 7 days of discovery of the fault, fully and clearly described.
2. Complaints can be submitted via:

3. Complaints submitted to the Business will be answered within 14 days of receipt. If a complaint is likely to require a longer processing time, the Business will respond within 14 days with a confirmation of receipt and an indication of when a fuller answer can be expected.

Section 13 - Disputes

1. Contracts between the Business and the Customer to which these Terms of Service apply shall be governed by Canadian law, except where mandatory consumer protection laws of the country in which the Consumer is ordinarily resident apply.

3. We are neither required nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

Section 14 - Changes

1. The Business reserves the right to modify these Terms of Service.
2. Modifications take effect on the announced date of entry into force.
3. Contracts already concluded are subject to the terms that applied at the time the contract was made.
